In Germany officially recognized the third gender
On 8 November the constitutional court of Germany decided about possible changes to the birth certificate so-called «third sex».Citizens who do not believe that your gender is neither male nor female, will be able in the future to designate it with another word. German Catholics have already expressed their disagreement with this procedure.
It is reported by «Rossiyskaya Gazeta».
Until the end of 2018, the government and the German Parliament should develop and adopt a relevant law. The rationale of the decision was recorded in the Constitution the right to self-determination of personality.
The original reason for the proceedings was the statement of the citizen, which had previously been recorded in the birth certificate as «baby girl». But the citizen was asked to fit it into a testimony with the words «inter» or «different». Because made earlier chromosome analysis showed that this person is neither male nor female.
Earlier, the claim was rejected at all instances, even the Supreme court. The constitutional court, however, ruled: gender identity is «a fundamental aspect of the person» and therefore protected by the basic law. In addition, the decision of the judges, gender identity occupies a key position in the self-determination and external perception of the individual.
So people have that evidence does not have characteristics of only one sex, such specificity must be taken into account in the birth certificate, and accordingly, in subsequent documents.
The constitutional court stressed that now the so-called «intersex» will be given the opportunity to «determine their sexual identity.» What exactly record can retroactively amend your document-like citizens — «inter», «different» or «positive definition of sex» — it is not yet clear (no appropriate concepts in the German language, because the concept of «intersex» in the novelty and for linguists).
This problem, German lawmakers have to decide until the end of 2018. It is noted that in November 2013, for such people were created the ability to opt out of the determination of sex in the birth certificate.
It is generally estimated that in Germany there are about 160 thousand «citizens of the third sex.» The German ethics Council in 2012, demanded that along with the female or the male sex these people would be given the option to select the designation «other.»
Before you make a decision the judges interviewed 16 expert unions and organizations. Along with the Council on ethics for the introduction of a «third gender» advanced German Institute for human rights, the German society for the study of genders and German society for psychology.
Against such decisions were made by Central Committee of German Catholics and of the Federal Union of workers of the registry office. According to them, change the gender in birth certificates is associated with significant financial costs.
Minister of family Germany Katharina barli praised the decision of the constitutional court. According to her, if a citizen is unable to voluntarily identify their gender in documents, is a violation of individual rights and of the prohibition of discrimination.
